Re: Flawed OCP Amendment Process for Anmore South and the Suppression of Political Expression in Anmore

Introduction
I am counsel for the Anmore Neighbours Community Association (“ANCA”).
My client and its many members and supporters have serious concerns about the manner in which Anmore’s Council is proceeding with the proposed amendment to the Official Community Plan (“OCP”) that will allow the Anmore South development to proceed.
There are two overarching problems that I discuss in some detail below:
that three of five Council members have already decided they will be voting in favour of the amendment and therefore have closed their minds to the issue; and
that Council has been violating Anmore residents’ rights of free expression in an unacceptable manner, suppressing and silencing voices that wish to be heard in relation to the Anmore South development.
In our view, these defects in the process leading up to the decision on whether to amend the OCP must be remedied before a decision is made. If Council chooses to disregard these matters and pushes forward with amending the OCP to allow the proposed Anmore South development to proceed, ANCA will be applying to the court to have the decision and the amendment set aside.
